Start with the scope
Identify the employer’s activities and the employees and positions described in the cao. Trading name or job title is not always decisive; scope may contain more specific conditions. Some businesses have multiple activities or special exclusions. Ask which facts underpin the employer’s cao choice. Where uncertain, record business activities and your own duties separately. An expert can then examine whether the chosen cao actually matches the enterprise’s operations.
Why might a cao apply to your contract?
The parties being bound, an incorporation clause in the contract and a declaration of general binding effect can each matter. These bases do not work identically in every respect. Ask not just which cao is named but why it applies to you. Compare the contract and relevant registration. A declaration of general binding effect requires attention to exact dates, binding provisions and any exemption. A cao being available online does not automatically make it compulsory for everyone.
Version and period matter
Pay scales, supplements and transitional rules may change during employment. Use the wording for the months concerned and retain old versions. Check whether a later agreement has retroactive effect. A declaration of general binding effect has its own start and end; do not assume it covers every gap without a cao. Effects after expiry also need separate assessment. This is particularly important for wage claims spanning several years.
| Check | What should you record? |
|---|---|
| Scope and basis of application | Which activities/roles are covered and why does this agreement apply to you? |
| Version and AVV period | Which text and any declaration of general applicability apply to the disputed month? |
| Scale and calculation | Which actual duties, step, hours, allowance and effective date support the amount? |
A payslip reference is an indication. Keep the actual provisions and schedules supporting applicability and calculation.
Minimum or standard cao
Not every more favourable individual arrangement is automatically permitted under every cao. A minimum cao generally allows more favourable conditions, whereas a standard cao may allow different scope for deviation. Examine its wording and system. Do not compare only two isolated amounts: a higher individual salary cannot always offset every separate cao entitlement. Where comparing a package, establish which components may legally be set off and which remain independently payable.
Job grading is more than a title
Compare actual duties with the job framework and grading rules. Responsibility, independence, knowledge and management tasks can matter. Retain job descriptions, task examples and earlier reviews. Ask why a particular scale and step were chosen and which experience counted. “Assistant” in a title does not automatically exclude higher grading where you regularly perform heavier duties. Also check whether the cao specifies an internal challenge procedure and deadline.
Turn a provision into a verifiable calculation
Suppose a cao provides an irregular-hours supplement. Identify relevant hours, percentage, pay basis and exclusions first. Do not combine all evening hours automatically if the rule uses other boundaries. Apply the same approach to sick pay, overtime or holiday: which event, period and calculation? Send a concrete comparison with your payslip. This makes the disagreement clearer and enables a cao party or adviser to address the interpretation specifically.
What if the employer does not apply the cao?
Request application and a reasoned response in writing. Cao parties can often explain; sometimes a dispute committee or enforcement organisation exists. A union, legal insurer or adviser can help with an individual wage claim. The ministry registers cao agreements and may declare provisions generally binding, but does not decide your interpretation dispute. Contacting the ministry also does not automatically preserve a limitation period. Establish the correct next step if payment remains absent.
Example: the wrong pay table
Your payslip names a cao but still uses last year’s table. First check the new table’s start and any retroactive effect. Then compare your scale, step, hours and pay components. Request arrears per month, including consequences for holiday allowance where relevant. This avoids correcting only current salary while earlier months and dependent amounts remain unaddressed. Request replacement payslips making the correction verifiable.
Practical checklist
- Find the applicable cao, its scope and legal basis.
- Keep the version and general-binding period relevant to your question.
- Check scale, step and separate pay components.
- Request written explanation and schedule challenge or claim deadlines.

Does a cao apply only if I belong to a union?
No. A contractual reference or declaration of general binding effect can be relevant, among other bases. Applicability needs assessment of the specific situation.
Can my contract be more favourable?
That depends on the cao and permitted deviations. A minimum cao generally allows room, while a standard arrangement may differ.
Does the ministry decide which scale I should receive?
No. Individual disputes should follow routes through the employer, cao parties, any committee and, where necessary, the court.
Which cao applies after a takeover?
This can be complex because of transitional rules and different bases of application. Keep old and new documents and have the situation assessed.
