Emergency leave: unexpected emergency, notification and pay

A phone call from school, a burst water pipe or a death may require you to stop work immediately. Emergency leave and short absence leave are intended for urgent or exceptional personal circumstances of this kind. They cover the time needed to deal with the situation. Another type of leave may be needed afterwards. A clear notification helps prevent the emergency absence from later being recorded as unexplained absence or ordinary annual leave.

The duration follows from the necessary actions: often several hours, sometimes several days.

There is no general legal maximum number of emergency hours per year; in any case, the conditions must be met.

Wages continue according to the main statutory rule, but check permitted collective deviations.

1. Recognize an acute or special situation

Emergency leave may be appropriate if you have to stop work immediately due to force majeure or have to deal with an urgent personal problem. Think of a sick child that needs to be picked up immediately from school or a serious problem at home for which you need to organize something immediately. Describe what happened and what immediate action is required from you.

Short absenteeism leave can also concern a special obligation that can only be fulfilled during working hours. The name urgent in an appointment confirmation is not decisive. This concerns the concrete circumstances and the reasonable duration of the absence. A normal move, planned day off or job application does not automatically give the same legal right; collective labor agreements regarding special leave may exist for this purpose. A concrete example is voting when this is only possible during working hours. Not every qualifying situation must therefore be unexpected. For a known obligation, explain why it cannot be fulfilled outside work and what time is actually needed.

2. Report as soon as reasonably possible

Contact your employer as soon as possible according to the usual reporting route. Explain in general terms why you have to leave, what tasks need to be taken over and how long you expect to be absent. If you cannot yet estimate the duration, please agree when you will contact your employer again. An uncertain end time is not surprising in a real emergency.

If it is impossible to call in advance, please report as soon as possible afterwards. Briefly record a telephone conversation by message or email. This makes it clear that you have reported leave and what information was available at that time. It is not necessary to send an extensive medical file of a family member to a group email address as a precaution.

3. Determine the necessary duration

There is no standard package of, for example, one day per event. The duration depends on what you reasonably need to arrange. It may take several hours to admit an emergency repairman; If arrangements are made immediately after a death, it may take longer. Once the acute actions are completed, you must assess which route suits the remaining absence.

An employer can ask for substantiation afterwards. Therefore, keep an appointment confirmation, message from school or other appropriate proof. Also note what you have arranged and when you were able to work again. There is no general statutory annual maximum, but that does not automatically justify each subsequent absence. The reason and duration must always be able to be explained independently.

Example: pick up and then take care of it

School asks you to pick up a suddenly ill child in the middle of the working day. Emergency leave may be appropriate for collecting and arranging childcare. If the child then needs necessary care that you have to provide, assess the conditions for short-term care leave. Do not book the entire week under the same emergency leave code without consultation.

4. Check wages and holiday deductions

Under the main statutory rule, wages continue during emergency leave and short absence leave. Check the collective agreement and permitted agreements with the works council or employee representatives, because collective variations may apply. If wages are deducted, ask the employer to identify the exact provision authorising the deduction. An HR form alone does not establish the legal basis.

Emergency leave is not automatically annual holiday. Check your leave record and payslip afterwards. If holiday hours are deducted, ask which agreement authorises this, which type of hours is involved and whether the necessary consent or collective basis exists. Dispute an incorrect entry in writing; otherwise the error may only emerge at the final settlement.

5. Doctor's visit, death and childbirth of your partner

A doctor or dentist appointment does not give an unconditional right to paid time off. Try to arrange routine appointments outside working hours. If a necessary appointment can only take place during working time, short leave may apply. Pregnancy check-ups have separate statutory protection, including necessary travel time. First check which rules cover your appointment.

After the death of a close family member, emergency leave may cover the immediate arrangements. A longer period for a funeral or mourning may fall under special leave in a collective agreement or contract. Emergency leave may also cover your partner’s actual childbirth. The partner’s paid birth-leave week after birth is a separate entitlement with its own time limit for use.

6. Refusal or conflict over size

A reasonable request for emergency leave may not be refused. However, discussion may arise about the necessity, duration or whether another type of leave is appropriate. Ask which facts the employer sees differently and explain what you need to do specifically. Where possible, discuss a practical transfer without postponing the urgent action.

If you receive a warning due to unauthorized absence, respond quickly and factually. Add the original notification and appropriate substantiation. Make it clear which part of the absence you consider emergency leave and how the rest has been discussed. Request specific legal assistance if wages are withheld or dismissal is mentioned; do not let a registration error develop into an undiscussed file.

7. From emergency solution to a sustainable agreement

After the acute event, longer care or a recurring scheduling problem may remain. Then investigate short-term or long-term care leave, parental leave, holidays or a temporary change in working hours. These rights have their own conditions and payment rules. The first emergency notification does not necessarily have to contain the definitive solution for the entire month.

Create a short timeline with the event, notification, necessary actions, contact moments and return. Then request an overview of the leave codes used and the payment. This way you can keep disagreements about the first hours separate from negotiations about future absences. Only keep necessary private information and share it specifically with the person who actually assesses the application.

Report the emergency as quickly as possible via the agreed route.

Indicate the expected duration and agree on a next contact moment.

Maintain appropriate justification and a short timeline.

Check collective labor agreement, pay slip and the leave code used.

Make a separate, appropriate leave or working-time agreement for any longer absence.

Am I always entitled to a full day off?

No, the necessary time is decisive. This could be less than a working day, but in certain circumstances it could be more. Explain what you had to arrange and when you could reasonably return to work.

How much emergency leave can I take per year?

The legal regulations do not have a general maximum number of hours per year. That is not an unlimited freely disposable balance: every event must meet the conditions and the duration must be reasonable. Also check the applicable collective agreements.

Can my employer ask for proof afterwards?

Yes, your employer may ask you to demonstrate that the leave was necessary. Provide appropriate information about reason and duration. This does not mean that you automatically have to submit the complete medical file of yourself or a loved one.

Is leave for a move also emergency leave?

A normal planned move is usually a request for special leave under collective labor agreement, contract or company scheme. An unexpected emergency at home may be different. Assess the event yourself and do not just use the general term private circumstances.
