Min-max contracts: guaranteed hours and availability

A min-max contract agrees a guaranteed minimum and a maximum number of deployable hours. The guarantee is the starting point for pay, but regular additional work may justify greater contracted hours. Also examine how widely you must be available. An eight-to-twenty-four-hour contract can affect your week much more than its minimum pay suggests.

Minimum hours are generally guaranteed hours payable even without deployment.

Extra work and availability must fit the contract, cao and on-call rules.

Distinguish guaranteed hours, actual work and the structural scope of employment.

Read minimum and maximum as separate arrangements

Record whether the range applies per week, month or year and how pay is made. A monthly minimum is not automatically four times a weekly minimum. Check whether fixed days or availability windows are agreed. Ask what happens if the employer wants to exceed the maximum or cannot schedule the minimum. Know not only how much you might work, but the minimum income on which you can rely.

Guaranteed hours protect income

With a min-max contract, the employer generally must pay the agreed minimum even when scheduling insufficient work. Compare payslips with the guarantee over the correct period. A quiet week under a valid monthly arrangement does not necessarily mean too few guaranteed hours have been paid. Have the employer substantiate any negative hours balance and establish who bears insufficient-work risk. An internal scheduling code cannot simply replace the contractual guarantee.

When must you work additional hours?

Within the agreed range, an obligation to answer a valid call may exist. The call-notice period and any cao matter. Outside the range, assessment differs; do not automatically treat every request as compulsory. State specifically when you cannot be available and refer to agreed arrangements. If you also work elsewhere, discuss predictable availability. An unlimited claim over your entire week does not automatically fit a limited guaranteed-hours package.

Record late calls and cancellations

Many min-max contracts fall under on-call agreement rules. Check whether calls were timely and whether cancellation within the relevant period preserves pay for the call. Keep both original and amended schedules. Describe pay differences by shift, including start and finish. This distinguishes guaranteed-hours payment from an additional entitlement for a specific cancellation. These calculations are not identical, and double counting must be avoided.

Regular extra hours may change the baseline

If you work near the maximum for months, consider the presumption of working hours and the offer obligation after twelve months of on-call work. Average hours matter, but the reference period and representativeness need assessment. A single holiday peak may carry different weight from a year-round pattern. Separate extra work, absence cover and seasonal peaks in your overview. Do not merely ask for “more security”; identify the working hours sought and the period supporting them.

Illness, holiday and minimum hours

Guaranteed hours are an important starting point during illness, while regularly working more or a specific call may require broader assessment. Report sick correctly and request the pay calculation. Holiday accrual also relates to additional hours. Check whether the holiday balance reflects the relevant actual scope rather than only an understated administrative minimum. A cao may contain additional rules on pay percentages, waiting days, supplements and reference periods for variable hours.

Resignation needs its own contract check

The special short employee notice period for a zero-hours contract does not automatically apply to every min-max contract. Check the ordinary notice clause, cao and contract type. Early departure from a temporary contract usually depends on a valid clause or another termination route. Before agreeing a new job, calculate how long current obligations continue. Maximum hours do not automatically disappear when you accept another offer. Record any earlier end date in writing after assessing consequences.

Example and future band-width rules

You have twelve guaranteed hours and a thirty-hour maximum but work almost twenty-eight hours for ten months. Prepare monthly records and note exceptional peaks. Have the structural scope assessed rather than merely waiting for an informal promise. Future flexible-work legislation introduces new band-width rules, but the relevant reform is due in 2028 according to the government. Assess the present contract under the law for its current period and check transitional rules later.

Record the period, minimum, maximum and availability arrangements.

Check guarantee payments and separate call-related entitlements.

Keep three- and twelve-month records of actual work.

Have sick-pay calculations and notice assessed specifically for this contract.

Are minimum hours paid when there is no work?

The agreed minimum generally consists of guaranteed hours. Check the relevant period and any specific contract or cao exceptions.

Can my employer always require the maximum?

That depends on agreed availability, valid calls and other rules. A maximum does not automatically provide unrestricted control over all your time.

Is my notice period the same as for zero hours?

Not automatically. Have the contractual and statutory period for your min-max contract checked before resigning.

Can I request a higher minimum?

Yes. Regular extra work can matter for the presumption of working hours and the offer after twelve months. Support the request with hours records.
