First put the facts on a timeline
Record the first day of sickness, contract type, original end date and date you received the proposal. Note whether you are still wholly or partly unfit for work and what return-to-work arrangements apply with the occupational physician. Performing limited work does not automatically mean full recovery. The legal assessment must match the actual circumstances, rather than just the heading on a document.
Gather your contract, recent payslips, draft agreement and relevant correspondence. Keep earlier versions: a change in the reason for ending employment or the effective date may matter. Medical information should not be included unnecessarily in the general HR file. For an initial consultation, a factual timeline of the sickness notification, advice and arrangements can be more useful than an unstructured collection of medical details.
Compare signing with continuing the contract
The question is not only whether the payment sounds attractive. Have someone calculate what would continue without an agreement and which entitlements the settlement ends. Compare the proposed end date, remaining period of pay, support arrangements and payment. A large gross payment can have a different effect from several months of continuing salary. Ask what happens if recovery takes longer than the parties expect.
Also distinguish a fixed-term contract reaching its original end date from an agreement ending employment earlier with your consent. These are different grounds for departure. The guide to leaving employment while ill discusses the first route; a settlement requires a separate assessment before you surrender rights.
Have the benefits route assessed separately
UWV assesses a benefit application under the applicable rules and facts. Your employer’s agreement or a standard clause in the settlement does not bind UWV. Ask the adviser to explain specifically how the first day of sickness, contract duration and actual incapacity for work affect your situation. Also ask what information must be supplied with an application.
An employee who remains ill when employment ends cannot simply assume they are available for paid work. That availability requirement matters for unemployment benefit, WW. At the same time, voluntarily ending employment during sickness can harm entitlement under the Sickness Benefits Act, Ziektewet. A solution must therefore involve more than replacing a sickness notification with the word “recovered” in a document. The facts must remain accurate.
Respond carefully to pressure to sign quickly
A short deadline set by the employer is not a reason to agree immediately. Request the complete documents and time for advice. Confirm factually that you are having the proposal assessed and have not yet agreed. Meanwhile, avoid statements about resigning, full recovery or final settlement if they are inaccurate or their meaning is unclear.
Keep a record of conversations and new proposals. Ask what has changed and have more than the initial payment checked. The end date, release of claims, removal of restrictive clauses and sickness-related arrangements can also change. Agreeing to an amended version may have consequences even if you thought you were discussing only one financial item.
Already signed? Have the cooling-off period checked immediately
A written termination agreement generally carries a statutory cooling-off period. Current government guidance states two weeks, or three weeks if the employer does not mention it. Immediately have the date the agreement was concluded checked, together with any special circumstance such as a previous withdrawal. Do not assume the period starts again because you later speak to HR.
If you want to dissolve the agreement, arrange for a clear written statement to reach the employer in time and retain evidence. Merely asking for more money or saying you have doubts sends a different message. Advice can still be useful after the cooling-off period has expired, but there is no general guarantee that the agreement can then simply be reversed.
Prepare for specialist assistance
For the first consultation, assemble a compact set containing the factual timeline, every draft version, contract, payslips and work arrangements with the occupational physician. State prominently whether you have already agreed and when. This helps the adviser identify possible urgency. The general settlement agreement check covers other payment and departure terms; during sickness, income and benefit consequences require a separate assessment as well.
Use the settlement agreement checklist to organise outstanding questions and the sickness route for the factual stage of recovery. Ask who will monitor the precise cooling-off period and what the engagement covers. Agree costs, possible insurance cover and any employer contribution to advice in advance. Request a written explanation of uncertain consequences: a contract clause or calculation does not replace a UWV decision or an assessment of your individual position.

Does a WW clause guarantee benefit?
No. UWV assesses the application. The wording cannot replace the applicable conditions and actual facts.
Am I recovered because I work a few hours?
A partial return to work does not automatically mean full recovery. Arrangements and assessment must reflect the actual situation.
Must I accept the proposal?
A settlement agreement requires agreement. Have someone examine what continues without consent and what other route the employer might pursue.
Does a settlement automatically give me the statutory transition payment?
Not automatically. The severance payment must be agreed; compare the whole package and entitlements under other ways of ending employment.
