Disagree with the dismissal order? Prepare an appeal in time

Do you disagree with the subdistrict court’s order concerning dismissal? Immediately establish whether an appeal is available, what you want to achieve and who will file it on time. For employment petition proceedings, the judiciary generally states three months after judgment and mandatory filing by a lawyer. Do not count from when you eventually read the post. Appeal also does not automatically suspend the order: income and work need separate attention meanwhile.

Check the judgment date and procedure, not merely receipt.

Appeal requires a lawyer even if you represented yourself initially.

Appealing a dismissal order does not automatically restore your job while you wait.

Identify the decision before you

Bring the complete order, date, case number, reasons and operative decision. Was employment dissolved, your annulment or restoration request refused, or only compensation decided? This determines what appeal can cover. A summary wage judgment is a different decision with another route; do not blindly apply this deadline.

Mark adverse parts and parts favourable to you. State your goal: return to work, a different financial result or correction of one component. The [general dismissal guide](guide:ontslag) helps identify the original route. Where your own dissolution request was granted, Article 7:683 limits appeal to the compensation specified there; do not assume a general right to reverse a dissolution you sought.

Record the deadline and lawyer’s instructions immediately

The ordinary appeal period in these dismissal proceedings is three months after judgment according to the judiciary. Have the exact last day checked against the decision and your position. Negotiations, asking the court for clarification or awaiting insurance do not automatically pause it. Set an earlier decision date and allow time to prepare grounds.

A lawyer must lodge the appeal. This requires more than an informal email protesting. Send the order immediately and say whether you previously acted personally or through a representative. Obtain written confirmation of acceptance of instructions and which filing will be handled. Use [finding a lawyer](tool:advocaat-zoeken) for suitable help; an exploratory conversation without accepted instructions does not prove your deadline is monitored.

Organise challenges to the reasoning

For each issue identify the reasoning you consider wrong and why it could change the result. Connect it to evidence, a fact or legal question. Merely repeating that the employer acted unfairly provides little direction. Also explain which documents or arguments you believe the first judge overlooked or misunderstood.

Provide original petitions, defence, exhibits, subsequent filings and any hearing notes. Use the [case-file builder](tool:dossier-builder) for a complete index. New facts or evidence must be introduced with procedural care; do not assume unlimited last-minute additions. Preserve original documents and identify missing versions or context.

Discuss what the appeal court can decide

Article 7:683 distinguishes situations. If the employer’s dissolution was wrongly granted, or the employee’s annulment or restoration request wrongly refused, the appeal court can address restoration or equitable compensation. Conversely, an employer’s appeal can affect a contract that survived the first decision. Outcomes depend on the challenged decision and requests.

Discuss not only prospects of success but the practical effects of restoration, any gap period and financial settlement. The appeal court need not simply reproduce the first outcome in reverse. The other party can also advance its own objections. Ask which requests are needed and what happens if one succeeds but other parts remain.

Follow the order unless another measure applies

For the dismissal orders covered by Article 7:683, appeal does not suspend enforcement. Filing therefore does not automatically continue the old job, wages or all earlier arrangements. Ask which specific obligations the order creates and whether a separate interim request is possible or necessary. Do not act as though the order has already been set aside.

Coordinate work, availability, pay and benefits with your adviser. Apply in time for [unemployment benefit](guide:ww) or other appropriate support where needed and report subsequent decisions and income. Restoration or back pay can affect earlier benefits. In [disputed summary dismissal](guide:ontslag-op-staande-voet), the chosen principal route and original requests remain relevant; appeal does not replace a missed initial filing.

Prepare a cost and decision plan

Ask beforehand about lawyer fees, court fees, coverage and adverse costs risk. Read [employment lawyer costs](guide:kosten-advocaat) as preparation and obtain a specified quotation. Success does not automatically reimburse all actual expense. Consider time, practicality of return and financial capacity across different outcomes too.

Any appeal settlement must specify treatment of the order, wages, compensation and proceedings. Ask when withdrawal is appropriate and who handles it. After the appeal judgment, cassation may be an issue, but it has separate rules, specialist assistance and deadlines. Do not wait for administrative closure before having a possible next step assessed.

Fictional example: reading the letter later

After moving home, an employee reads a dismissal order weeks after judgment and assumes three months run from that reading date. A lawyer immediately requests the judgment date and full file and checks the real deadline. They also discuss that appeal does not itself suspend dissolution and income must be arranged meanwhile. The example promises neither extension nor restoration. It shows why late personal awareness is not a safe timetable and why instructions, grounds and financial effects need attention together.

Complete order with judgment date and case number.

Original requests, defence and every exhibit.

Disputed reasoning linked to evidence.

Desired outcome and risk of the opponent’s objections.

Accepted lawyer instructions and final filing date in writing.

Plan for work, income, benefits and litigation costs.

Can I send my own protest to the appeal court?

A lawyer must file this appeal. Your own protest letter is not a safe substitute. Obtain concrete confirmation of instructions and timely filing.

Do I automatically remain employed during appeal?

No. Appeal against orders covered by Article 7:683 does not suspend enforcement. Have current obligations and possible interim relief assessed separately.

Do three months also apply to a summary wage judgment?

That is another procedure and may have another deadline. Identify the decision type first; do not use one period for all employment litigation.

Can I simply repeat my previous arguments?

The lawyer must formulate targeted objections to the order and the desired decision. Existing arguments may remain important, but explain the faulty reasoning and provide the full litigation file.
