1. What does the Raad assess after completion?

In a civil case, the Raad can assess whether the financial result justifies having the aid ultimately borne by oneself. That is a different question than whether you had little income or assets at the start. A settlement can therefore also raise a financial follow-up question about legal aid.

The explanation of the Raad about financial result describes this assessment. Ask the lawyer which yield is reported, how it is determined, and at what moment the assessment takes place. Do not reserve based on an arbitrary online threshold amount; the applicable standards and exceptions must fit your case.

2. Split wages, compensation, and other items

A final settlement can consist of back pay, vacation days, holiday pay, severance pay, interest, and a contribution to legal costs. A repayment obligation can also play a role. Not every item is automatically a result achieved by legal aid; the origin and coherence must be assessed.

The Raad provides examples for severance pay and wages where the different items have different outcomes. Use those examples to formulate questions. The older example standards used therein are not current amounts for your application. Keep gross, net, and conditional amounts recognisably separate.

3. Request attention for related procedures

For example, there may be a wage procedure and a separate dismissal procedure ongoing. Two toevoegingen do not automatically mean that the result is assessed completely separately. Have the lawyer explain how the coherence and scope of the aid are processed.

Therefore, make one overview of procedures, agreements, received amounts, and any claims. Check which amounts have already been paid and which are still disputed or will become claimable later. The policy rule on civil scope helps explain why the number of files is not the only measure.

4. Illustrative example: four amounts in one arrangement

An employee sees in a draft arrangement back pay, a departure compensation, payment for free days, and a budget for legal advice. He cannot add up these items without explanation into one so-called subsidy result. First, it must be clear what each item entails and whether it was obtained through legal aid.

He asks the lawyer to make an overview per item and explain the possible consequences for subsidy and billing. If a benefit must be repaid, he includes the decision for assessment. This fictional example does not determine which deduction is allowed and does not provide a net yield guarantee.

5. Recheck concerns a different financial basis

When the Tax Authority later definitively establishes used fiscal data, the Raad can check the earlier financial assessment. This can also play a role when an estimate was used in peiljaarverlegging. Recheck is therefore not the same as the assessment of yield from the employment case.

Keep the application, the financial forecast, the toevoeging decision, and final tax data. Ask with a new letter whether it concerns recheck, result assessment, or another correction. The official explanation of the consequences of recheck helps with that initial classification. Check the specific response instruction and deadline.

6. Discuss the final settlement before you give consent

Ask which tariff agreement applies if the toevoeging lapses and how an earlier personal contribution, advance, or employer payment is processed. Distinguish between a lawyer's bill and an amount the Raad reclaims. Leave uncertain items and decisions by third parties visible in the estimate.

Also read during negotiations VSO and employer's contribution. With the worksheet, you can organise the items and questions before an arrangement is signed. The sheet does not calculate tax, benefit rights, or final result assessment; for that, the full documents and the competent assessor are needed.

Practical checklist

  • A breakdown of all items in the arrangement or ruling.
  • Gross, net, claim, and payment date separately.
  • Any demonstrable repayment obligations.
  • The agreement on lawyer's fees upon withdrawal and settlement.
Practical preparation

Prepare for the conversation

Only fill in short notes. Do not record BSN, children's names, medical information, or other sensitive data. This worksheet helps you organise questions; it does not calculate entitlement to subsidy.

Your notes remain on this page in your browser. This worksheet sends and saves nothing. Download only on a device where you want that; you decide with whom you share the file.

Split wages, compensation, other settlement, and legal costs.

Why is the item owed and when will it be paid?

Which substantiated obligations need to be assessed?

Which bill and settlement does the lawyer explain?

Take this to your conversation

  • A breakdown of all items in the arrangement or ruling.
  • Gross, net, claim, and payment date separately.
  • Any demonstrable repayment obligations.
  • The agreement on lawyer's fees upon withdrawal and settlement.

This is general information about Dutch law. The worksheet is not an application, objection, calculation of entitlement to subsidy, or confirmation of an assignment. Check deadlines in your own documents.

Frequently asked questions

Does my toevoeging lapse with every severance pay?

That does not follow solely from the name of the amount. The Raad assesses the relevant result, the standards, and any exceptions.

Can back pay also be a result?

That can be relevant. The coherence with the provided legal aid and the applicable rules must be investigated.

Is an oral cost estimate sufficient for my decision?

Request the principles and agreements in writing. In case of a possible withdrawal, you want to know which bill may follow and what uncertainties remain.
