Work conflict: trade union, legal expenses insurance, or pro deo?

In a work conflict, you may already have assistance through a union or legal expenses insurance. Additionally, subsidised assistance may be an option. First, investigate what concrete help is offered and under what conditions before commissioning new paid assistance.

Existing assistance is only clear after admission or coverage is confirmed.

Having your own external lawyer does not automatically mean their bill will be reimbursed.

Align the funding route with the substantive assignment.

1. Map out your existing arrangements

Look up your policy, membership details, collective labour agreement arrangements, and any employer scheme. Note when the conflict began and when you reported it. Ask the provider if your specific dispute and the requested work fall under the scheme. The mere existence of insurance or membership does not yet prove coverage.

UWV mentions advice from a lawyer, union, or legal expenses insurer in case of dismissal. These routes may have different methods and conditions. The [official dismissal explanation](https://www.uwv.nl/nl/ontslag/werknemer-ontslaan) is a starting point; admission by the relevant organisation remains a separate step.

2. Ask what the offered assistance precisely entails

An initial telephone advice, a letter to the employer, negotiations, and representation in a procedure are different tasks. Ask which of these the organisation performs, who your contact person is, and how quickly an urgent question is assessed.

When referring to an external office, confirm who gives the assignment and what is paid. Discuss a budget cap, deductible, and conditions for extra work. A referral is not always the same as an unconditional payment guarantee for every subsequent step. Therefore, keep the confirmation alongside the assignment.

3. Free choice of lawyer requires explanation about phase and reimbursement

The right to choose your own lawyer and the precise extent of the reimbursement require assessment within the applicable scheme. Do not assume unlimited payment of a self-chosen office. Ask the insurer which procedure or situation makes a choice possible and how permission and declaration are arranged.

If you want to switch because you are dissatisfied with the approach, describe the specific disagreement and ask about the complaints or dispute route. Simply hiring a second lawyer can cause new costs. Share correspondence with the new advisor so that the issue of coverage and the employment case remain separate.

4. When to investigate a toevoeging?

A toevoeging is applied for by a lawyer registered for that purpose. The Raad assesses financial and substantive conditions. Tell the lawyer what assistance or reimbursement is already available and why it is or is not usable. An insurance rejection does not in itself prove entitlement to subsidy.

Also assess which tasks are necessary and whether another suitable provision exists. The [conditions of the Raad](https://www.rechtsbijstand.nl/mediation-rechtsbijstand/voorwaarden/) and the [application route](https://www.rechtsbijstand.nl/mediation-rechtsbijstand/gesubsidieerde-mediation-rechtsbijstand/aanvragen/) provide the main line. For a recent income drop, read [pro deo after dismissal or income loss](guide:pro-deo-ontslag-inkomensdaling).

5. Illustrative example: coverage still under investigation

An employee receives a dismissal proposal and reports it to his insurer. The office he contacts himself offers a paid review. As long as coverage is not confirmed, he must know who pays for that review and whether the insurer can provide an assessment in time.

He asks both parties to coordinate the deadline and assignment. This prevents him from thinking he has one free route while two assignments are running. The example does not guarantee that waiting is possible; a lawyer must assess the real deadline and confirm who acts in time if necessary.

6. Keep costs and responsibilities in one overview

Create a row for each route with provider, extent of assistance, admission status, own costs, and responsible party for the next step. Use confirmed, applied for, and still unknown as clear statuses. Also note which route is terminated if you choose another.

Ask about an employer's budget and how it aligns with insurance, union, or toevoeging. Read [the VSO budget guide](guide:vso-pro-deo-werkgeversbijdrage) for those arrangements. With a written assignment and a new budgeting moment for extra work, it remains clearer what you are actually buying and who bears the cost.

Policy, membership, and written coverage assessment.

Start of the conflict and date of reporting.

What tasks each offer includes.

Who performs and pays for the urgent employment law step.

Do I always have to contact my insurer first?

Investigate existing coverage early and report it to the lawyer. Which route is appropriate depends on the scheme, the case, and the urgency.

Does an insurance rejection entitle me to pro deo?

Not automatically. The financial and substantive conditions of the toevoeging must be assessed separately.

Can I have two service providers work simultaneously?

That can lead to unclear assignments and double costs. Agree on the division of tasks and reimbursement in advance.
