What was the situation when returning to work?

In the published decision the judge describes an employee who returned after illness and leave without a clear reception, guidance or access to the systems. Resumption of work in her own position did not get off to a good start. The employer then focused on work outside its own team and on termination, while the possibilities within its own position had not been sufficiently utilized, according to the judge.

The key is not only that parties communicated unpleasantly with each other. The judge looked at the actual organization of the return: which tasks were available, who supervised the employee and why was his own position put aside? The lack of a concrete justification for this played an important role. The court decision does not establish a general rule that every failed return will result in the same compensation.

What is the difference between track 1 and track 2?

In track 1, return is investigated within the own organization; track 2 concerns work with another employer. In this case the issue was that the employer was too quick to relinquish work in his own position. The judge did not read sufficient justification for that approach in the available expert opinions. See also our explanation about reintegration during illness for the individual steps.

This does not mean that a second track should never run alongside research within your own organization. It is also not a guarantee of returning to the exact same tasks. This court decision therefore does not rule out exceptions and a substantiated different approach based on current expert advice. Limitations, recovery expectations and appropriate options may require a different route. The practical question is whether the choice is based on current advice and concrete efforts. A manager who does not have time for guidance does not yet answer the question of what is medically and occupationally possible.

How can an employment relationship be disrupted while the employer is at fault?

Rescission and culpability are different questions. A collaboration may ultimately have come to a serious and lasting standstill, even if the employer played a large part in this. UWV - termination of the employment contract for personal reasons via the subdistrict court describes the route for personal grounds for dismissal, including a disturbed employment relationship. The court may terminate the agreement subject to fair compensation if there is a legal basis for doing so.

In this case, discussions and mediation did not help the parties to resolve the impasse. The judge ultimately found that redeployment was no longer appropriate and pointed to the further development of the conflict. That judgment stands in addition to the criticism of the previous reintegration. It is therefore insufficient for a defense to simply say that the employer caused the conflict. Also describe whether recovery or a specific alternative workplace is still feasible. For more information, read defense in the event of a disrupted employment relationship.

Why did parental leave matter?

According to the judge, the employer handled the request for paid parental leave incorrectly and unsympathetically. Reintegration was contrasted with leave. Central government - Applying for parental leave makes the distinction between the right to leave and the desired distribution of hours. A compelling business interest may be a reason to discuss the division; that is different from rejecting the right to leave as a whole.

In a file with illness and leave, both subjects must therefore be recorded separately. Save the request, the desired dates, the employer's response and the concrete motivation. Also explain when postponement has consequences for a time-bound right to payment. The court decision does not give license to unilaterally ignore reintegration agreements once leave has been requested; it shows that an employer must carefully treat different obligations side by side.

When does insufficient guidance turn into seriously culpable conduct?

The high threshold for fair compensation requires more than a single clumsy email or planning that goes wrong. In the case discussed, the judge looked at the whole thing: failure to initiate a return to one's own position, deviating from advice, dealing with parental leave and the vulnerable position of the employee. The repeated course of events was decisive.

Therefore, for a possible assessment, always compare which obligation or agreement applied, what actually happened and what the consequences were. This creates a testable pattern. The general criterion and the substantiation of the amount are also stated in substantiate a fair compensation after termination of the employment contract. The single label of seriously culpable does not replace facts and documents.

Why was €100,000 mentioned and not the requested amount?

The employee requested more than €267,000 before tax deductions. In its assessment, the subdistrict court judge, among other things, considered the question of how long the employment relationship would have lasted without the alleged conduct. The judge considered a period of three years more plausible than the five years mentioned by the employee. The requested non-material damage was insufficiently substantiated; Pension damage was also not included.

The judgment resulted in €100,000 before deduction of tax fair compensation, under the condition set out in the decisive part of the court decision. This does not result in a calculation table for every employee who experiences reintegration problems. A different career, labor market position, income development or evidence position may lead to a different assessment. For your own claim, make a distinction between demonstrating seriously culpable conduct and substantiating the financial consequences thereof.

What does the option to withdraw the request mean?

The employer could withdraw its application to terminate the employment contract by 26 October 2026. The operative part provides for termination on 1 January 2027 and payment of the compensation only if the application was not withdrawn in time. If it was withdrawn, a separate ruling on legal costs applies. Reading the compensation figure in isolation therefore misses a condition governing the outcome.

The sources checked on 28 October do not establish whether the employer actually withdrew its application. They also do not establish the status of any appeal. This article explains the published court decision; it does not establish that the employment contract has ended or that any compensation has been paid. Those conclusions require further evidence.

Which documents make a reintegration problem controllable?

Save the problem analysis, the action plan, the evaluations, functional advice from the company doctor and concrete offers of tasks or positions. Link each event to a date. In the event of a difference of opinion, an expert opinion from UWV may be relevant. Ask in advance which question UWV can answer; an expert opinion is not the same as a judicial decision on severance pay.

Keep medical information and organizational evidence separate. A case file is not intended for a broad mailing to managers. The relevant restrictions and possibilities are particularly important for the working agreements. Concretely record a missed appointment, missing system access or a refused task, and give the employer the opportunity to respond. This way you prevent a series of difficult-to-verify memories from remaining until the end.

Example: make a general complaint concrete

Illustrative example: you write that you are not allowed to return, but the employer says that suitable work was always available. An overview with the dates of your requests, advice on hours accrual, the tasks offered and the actual access to work can then clarify where the difference lies. An email in which you ask for a supervisor and a defined range of tasks is more concrete than just stating that everything is going against you.

Also add information that makes your own position less simple, such as a suitable offer to which you have not responded. An advisor must be able to assess the weaknesses. The example is fictitious and does not provide evidence of a similar error. The goal is a file that makes the choices of both sides visible, not a collection of exclusively unfavorable quotes from the other party.

Step-by-step plan in case of impending termination of the employment contract after stalled reintegration

Step 1: ask what grounds for dismissal are being put forward. Step 2: compare the medical and occupational advice with the actual work agreements. Step 3: request a concrete recovery or redeployment proposal in writing if this is still possible. Step 4: have a request to the court to terminate the employment contract or severance package assessed immediately. Case law - termination of the employment contract and procedures before the subdistrict court describes how the procedure before the subdistrict court takes place.

A complaints procedure, conversation with the company doctor or expert opinion does not automatically monitor a separate process or response period. Therefore, continue to pay attention to received procedural documents. Also read termination of the employment contract in the event of illness, addressing an employment dispute and a settlement agreement during illness. The best route depends on recovery options, the stage of the procedure and your income position.

Practical checklist

  • Create one timeline with illness, leave, advice, resumption of work and conversations.
  • Save concrete proposals for your own work, adapted work and other functions.
  • Separate medical data from documents about work organization and communication.
  • Formulate which expert question is still unanswered and which procedure is underway.
  • Have dismissal documents and terms assessed; do not use €100,000 as the default amount.

Frequently asked questions

Did this employee definitely receive €100,000?

This is not apparent from the decision consulted. Termination of the employment contract by the court and compensation are linked to failure to withdraw the employer's request in a timely manner. Whether this has been withdrawn and whether payment has been made has not been determined during this source check.

Is a second track always incorrect if return to the employer is still being investigated?

No. Different activities can be relevant at the same time. The criticism in this case is about letting go of returning to one's own position too quickly without sufficient justification. Have the actual advice and efforts assessed.

Will I automatically receive fair compensation for poor guidance?

No. The judge assesses whether the actions meet the high threshold of serious culpability and what consequences are associated with this. A shortcoming, the connection with the termination of the employment contract and the amount each require substantiation.

Do I have to choose between parental leave and reintegration?

That general contradiction is too simple. The right to leave, the distribution of leave and the concrete reintegration agreements must be carefully assessed side by side. Record both requests in writing and request a reasoned response.

What is the difference between transition compensation and fair compensation?

The transition compensation has its own legal conditions and a calculation based on the employment relationship. Fair compensation requires a separate basis and assessment. This decision mentions both amounts, subject to the withdrawal condition.
