Insolvency wage guarantee: covered amounts, periods and limits

The Dutch insolvency guarantee does not cover every employment debt without limits. Different components have different periods and a ceiling applies. A clear item-by-item record helps reconcile advances, the final account and remaining trustee claims. These general limits do not calculate an individual entitlement.

No. Separate periods apply, including up to thirteen weeks of arrears before dismissal, and the award is capped.

No. UWV describes up to twelve months of contributions, paid directly to the pension provider.

It may remain for the later reconciliation. Ask what was included rather than assuming final rejection.

1. List claims before combining amounts

For every item, record what is owed, the period concerned and the supporting evidence. Distinguish arrears, notice-period wages, holiday allowance, holiday hours, pension and other claims. An amount on the final payslip does not necessarily belong entirely to one coverage period. The earning period and the date payment became due may differ.

Keep columns for gross entitlement, money received, outstanding balance and the organisation handling it. Identify disputed items. This reduces both duplicate claiming and forgotten residual debt. If UWV and the trustee use different dates, ask for the reason; they have different responsibilities and do not necessarily determine the same legal question. Retain the explanation alongside your calculation.

2. Wage arrears have a thirteen-week limit

UWV describes taking over wages due for up to thirteen weeks before dismissal. This is not simply every sum that happened to become payable during the last thirteen weeks. The period in which the wages were earned must be assessed under the scheme. Confirm the relevant dismissal and reference dates instead of assuming the bankruptcy date answers every timing question.

Covered wages can include overtime and certain allowances. Support the entitlement with the collective agreement, contract, roster or approval. A bonus earned over another period or an unusual payment needs its own explanation. Do not copy the payroll total without identifying months and components. Older wages may remain a claim for the trustee rather than being covered by UWV.

3. Notice-period wages have a six-week ceiling

UWV describes coverage for notice-period wages up to six weeks. The actual notice period and its start depend on the termination and applicable rules. Bankruptcy therefore does not automatically identify the last employment day. Keep the notice letter and request confirmation of any inconsistent date before estimating the coverage or applying for subsequent income.

Work, new earnings and requested income statements can matter for payment during this period. Record days worked and a new job's start. New employment does not erase an old debt, but overlapping income still needs correct reporting and treatment. Ask UWV how your actual earnings are handled instead of subtracting amounts informally without understanding the applicable periods.

4. Holidays and pension use a different period

UWV describes holiday allowance and holiday days due in the twelve months before employment ended. It also identifies up to twelve months of unpaid pension contributions, paid directly to the pension provider. These are different timing rules from the thirteen-week arrears limit. Do not apply the wage limit to every item merely because they appear on one final account.

Request a holiday record showing accrual and use, and evidence of pension registration. Pension money not reaching your own bank account has not necessarily been omitted. Ask the provider which contributions were missing and which were later received. Keep older claims separately for the trustee. Multiple pension arrangements or disputed holiday hours may require further evidence and calculation before the account can be reconciled.

Illustrative example

An employee has sixteen weeks of unpaid wages. They identify which weeks UWV may cover and list the older remainder separately for the trustee, avoiding counting advances twice. Fictional example: dates and limits still require assessment.

5. Coverage is limited rather than full compensation for every loss

UWV describes a maximum of 150% of the maximum daily wage. Higher earners may therefore receive less than their full contractual earnings through the guarantee. Use the applicable ceiling and period in the decision. A residual amount does not automatically cease to be a debt simply because UWV does not take it over, although its legal basis still needs checking.

Separate the proposed UWV portion from any remaining claim and ask which components were capped. This guide avoids a fixed euro ceiling because indexed amounts can change. A historical payslip needs the applicable assessment, not a random current net figure. Mark estimates as estimates until the decision explains the period, included components and limit actually used.

6. Reconcile advances with the final account

An advance may cover fewer components than the final reconciliation. UWV describes a final account including later-assessed items such as holidays and pension. Keep every statement and mark money already paid. A list of original entitlements without subtracting advances can overstate the amount still outstanding, even if every initial item was correctly recorded.

At the final stage, check period, basis, cap and payment for each item. Ask whether a difference results from missing evidence, an uncovered period or a calculation error. Make any correction request specific and protect the formal challenge deadline. Asking the trustee to confirm a figure again does not replace responding to a UWV decision within the applicable period.

7. Submit residual claims with realistic expectations

Submit supported amounts outside UWV coverage to the trustee, including older wages or amounts above the limit where legally due. Other entitlements require their own legal basis. Ordinary transition compensation is not automatically payable in the usual way in bankruptcy, so check exceptions before presenting an amount as a certain entitlement or including it in your income budget.

Request acknowledgement and registration, but do not treat a submitted claim as guaranteed future income. Creditor ranking and available assets affect payment. Keep contact details and the case reference after starting another job. Use [the application guide](guide:uitkering-betalingsonmacht-aanvragen) for forms and reporting, and [the main insolvency dossier](guide:werkgeversfaillissement) for work instructions, restart and subsequent unemployment.

Compare the relevant dates with the current agreement or decision.

Keep the application, payslips, correspondence and proof of receipt.

Ask for a written explanation of discrepancies and monitor the deadline in the decision.

Discuss medical details with the occupational physician and a legal dispute with appropriate legal assistance.

Does UWV cover every old wage debt?

No. Separate periods apply, including up to thirteen weeks of arrears before dismissal, and the award is capped.

Does the thirteen-week limit also apply to pension?

No. UWV describes up to twelve months of contributions, paid directly to the pension provider.

Why is holiday allowance missing from my advance?

It may remain for the later reconciliation. Ask what was included rather than assuming final rejection.

Will the trustee definitely pay a submitted claim?

No. Submission or recognition does not guarantee payment; available assets and creditor ranking matter.
